The regular meeting of Council of the Municipal District of Wainwright No. 61 was held in the Municipal Administration Building, Wainwright, Alberta on Tuesday, August 17th, 2010 commencing at 9:00 a.m.

Present: Reeve Bob Barss, Councillors Morley Muldoon, Phil Valleau, Shelly Andersen, Oscar Buck, Ted Wilkinson and Myron Zajic. Staff  present: Municipal Administrator Kelly Buchinski, Assistant Municipal Administrator Bonnie Milton and from the Star News, Kelly Clemmer (9:25

a.m. to 1:15 p.m.)

NEW BUSINESS

 

Agriculture Service Board

 

The Agricultural Fieldman, James Schwindt, attended the meeting  from 9:05 a.m. to 9:20 a.m. and 1:45 p.m. to 1:50 p.m. and reported to Council on the activities of the Agricultural Services Department for the past month.

A copy of the ASB Minutes from August 9th, 2010 were received and distributed to Council.

 

The Agricultural Fieldman advised Council that the mowing program for 2010 is complete.

 

The Agricultural Fieldman gave Council an update of the attendance of the 2010 Rural Routes Supper.

Moved by Clr. Buck that the Municipal District of Wainwright No. 61 be authorized to proceed with a Rural Routes Supper and Social Event for August 5th, 2011 with the addition of having a coin collection for the food bank as a volunteer option from participants. CARRIED

Moved by Clr. Buck that the Municipal District of Wainwright No. 61 support the Petrie Farms Limited c/o Jim and Mavis Petrie application for the 100 Year Farm Family Award. CARRIED

 

The Agricultural Fieldman handed out a map showing where the Nodding Thistle weeds have been located, noting that they have been addressed.

 

Safety & Utilities

 

The Safety & Utilities Manager, Preston Iverson, attended the meeting from 9:20 a.m. to 9:30 a.m. and reported on the activities of his department for the past month.

Recreation & Community Services

Moved by Clr. Wilkinson that the Municipal District of Wainwright No. 61 authorize the Denwood Outdoor Athletics Club to host an Arm Lake Trail Race at Arm Lake Recreational Centre on September 18th, 2010 and to use the Arm Lake narrow trails subject to proper insurance being in place and each participant signing a waiver of liability. CARRIED

 

Public Works

 

The Director of Transportation, Mark Greibrok, attended the meeting from 9:30 a.m. to the end and reported to Council on the activities of the Public Works Department on behalf of the Director of Public Works Shannon LaHaye and the Transportation Department for the month.

Moved by Clr. Zajic that the Municipal District of Wainwright No. 61 approve the Director of Transportation’s report as presented. CARRIED

 

Ronan Le Fur from Soilworks and Craig Reid from Knelson Sand & Gravel Limited attended Council at 9:45 a.m. to discuss Durasoil and how to monitor the amounts being put down. Mr. Reid advised that there is a meter on the truck and the product can be metered but he was under the impression that the dust control would be 100 meters and when they arrived they were considerably longer and that is why the first truck only did 4 dust controls. The application rate is 1.4 litres per square meter and the years after initial application will be approximately 30% of first application.  Tandem truck holds 14,000 litres and will do 1000 meters of road depending on the width of the road. Cost is $2.10 per litre.  It was consensus of  Council that the product is very good and we will be monitoring it per division to see how it holds up over the winter. Mr. Le Fur advised that the sandier the soil the better the product works. Mr. Reid advised that they never calculated any truck costs because they are trying to get the product out and in the future the product will be available for purchase and the M.D. will be able to apply it with their own forces. Mr. Le Fur introduced another product called Soiltac which is being used for solid, erosion and dust control. He also advised this product is also sold in volume. It was noted that this product doesn’t work well with a clay base unless sand and aggregate is brought in to stabilize the road. Putting chip seal on it would help it to last longer, probably as long as the chip seal lasts. It was the consensus of Council to have Mr. Reid advise the Director of Transportation the cost of the product.

 

Steve Xuereb from Mainstream Renewable Power Ltd. attended Council at 10:45 to give an update on the wind energy industry and their project in the

M.D. of Wainwright No. 61 located 14km North of Irma.

 

Mike Schmidt attended Council at 11:00 a.m. to introduce himself and advised that he is the Governmental Account Manager for Brandt Tractor Ltd.

 

The Director of Transportation advised Council that Carillion has never replied with regard to 2010 crackfilling and now it is too late in the season for this project.

Moved by Clr. Buck that the Municipal District of Wainwright No. 61 be authorized to not proceed with the 2010 Crackfilling Contract with Carillion. CARRIED

 

A copy of the rental equipment costs with regard to dry renting vs. operator supplied information was received and distributed to Council.

Moved by Clr. Muldoon that Administration do a cost analysis of building one mile of road with own forces vs. the private sector. CARRIED

Moved by Clr. Buck that the Municipal District of Wainwright No. 61 be authorized to get prices for a salt mixer and also a price from a contractor to mix 2010 salt requirements. CARRIED

Moved by Clr. Valleau that the Municipal District of Wainwright No. 61 be authorized to change the following yield signs to a stop signs and that these stop signs be added and the yield sign be removed from Appendix A of Bylaw No. 1334:

A copy of a cost estimate from CIMA for an intersection at Twp Rd 45-4 & Highway #41 (Truck Pit Road Project) was received and distributed to Council.

Moved by Clr. Valleau that the Municipal District of Wainwright No. 61 authorized the intersection improvement at Twp Rd 45-4 and Highway #41 (Truck Pit Road Project) for an additional cost of $343,470.00. CARRIED

Moved by Clr. Andersen that the Municipal District of Wainwright No. 61 be authorized to extend the lease agreement with Carillion Canada Inc. for the use of Lot 6, Block 1, Plan 8120814 (Salt Shed) until May 31st, 2012. CARRIED

 

A letter was received from EastLink (Persona Communications) requesting an extension of their lease with the M.D.

Moved by Clr. Wilkinson that the Municipal District of Wainwright No. 61 be authorized to extend the lease agreement with EastLink (Persona Communications) on Plan 902 1671, Block 4, Lot 2 to March 31st, 2011. CARRIED

Moved by Clr. Valleau that the Municipal District of Wainwright No. 61 be authorized to hire Genivar to do an engineering assessment on BF7268. CARRIED

Bylaw No. 1500

A Bylaw of the Municipal District of Wainwright No. 61 in the province of Alberta being a Bylaw proposing to amend Bylaw No. 1318, as amended May 15, 2007, of the Municipal District of Wainwright No. 61 to amend the Land Use Designation of Pt. of NE 12-45-8 W4M from Agricultural District to Country Residential District.

 

Reeve Barss asked if there were any written submissions.    There were none.

The Municipal Accountant, Mary Nelson, attended the meeting from 11:40

a.m. to 11:59 a.m. and reported to Council on the finances for the past month.

Moved by Clr. Wilkinson that the accounts recorded on the attached list in the amount of $3,222,898.56 covered by debit memos 1435 to 1445 and cheques numbered 61368 to 61587 be approved and paid and that the payroll payments as per the attached list totaling $291,000.21 covered by EFTs numbered 900017906 to 90018065 be ratified. CARRIED

Moved by Clr. Zajic that the financial statement of receipts and disbursements for the month ending July 31st, 2010 be adopted as written and incorporated into these minutes. CARRIED

 

Administration & Taxation

 

A copy of the monthly status report was received and distributed to Council.

 

A copy of a letter from the Minister of Municipal Affairs was received and distributed to Council advising that the following capital project has been approved under MSI Funding:

 

  • CAP-02347 Township Road 42-2 Paving Project for $2,375,418.

 

A copy of a letter from Municipal Affairs was received and distributed to Council requesting individual qualifying members to have their names posted on the registry of Qualified Assessment Review Board Members and Clerks on their website.

Moved by Clr. Buck that the Municipal District of Wainwright No. 61 be authorized to release the individual qualifying members’ names to be posted on the website at Municipal Affairs for Qualified Assessment Review Board Members and Clerks. CARRIED

Moved by Clr. Valleau that the Municipal District of Wainwright No. 61 be authorized to hold an advance vote pursuant to Section 73 of the Local Authorities Election Act on October 12th, 2010 from 10:00 a.m. to 6:00 p.m. at the Municipal District of Wainwright No. 61 Administration Building. CARRIED

 

A copy of the A.A.M.D.C. Member Bulletins, Contacts and Executive Highlights were received and distributed to Council.

Moved by Clr. Buck that the Administrator respond to the Pit Reclamation Security and Environmental Assessment Survey from the AAMD&C indicating that we don’t require any changes. CARRIED

Protection to Persons and Property

 

A copy of a letter from Kevin Christian was received and distributed to Council advising that he is retiring from the Wainwright Fire/Rescue Department and thanking Council for the opportunity to serve the community.

 

An invitation was received and distributed to Council with regard to the grand opening of the new Irma Fire Hall on September 10th, 2010.

Moved by Clr. Zajic that the Municipal District of Wainwright No. 61 have no objections to the proposed subdivision in the NE 30-45-5 W4M subject to the applicant installing an access approach. CARRIED

Moved by Clr. Wilkinson that the Municipal District of Wainwright No. 61 have no objections to the proposed subdivision in the SW 24-46-6 W4M subject to the applicant installing an access approach to the new parcel and to the balance of the land. CARRIED

408.10                Moved by Reeve Barss that the Municipal District of Wainwright No. 61 authorize Conoco Phillips Canada to install a permanent development on SW 28-47-10 W4M that will be within the 40 meter set back of the road allowance. CARRIED

409.10                Moved by Clr Buck that the Municipal District of Wainwright No. 61 be authorized to enter into an agreement with Talisman Energy for the Surface Lease renewal on the SE 12-43-3 W4M for a 5-year term in the amount of $2,350.00 per annum. CARRIED

410.10                Moved by Clr. Zajic that the Municipal District of Wainwright No. 61 approve the draft letter to Mr. & Mrs. Tom Suley with regard to the Access to the Municipal Reserve at Clear Lake. CARRIED

IN-CAMERA ISSUES

411.10                 Moved by Clr. Wilkinson that Council recess for a private meeting, as per Section 197(2) of the Municipal Government Act 2000 and amendments. (1:16 p.m.) CARRIED

412.10                 Moved by Clr. Muldoon that Council reconvene to the regular council meeting. (1:50 p.m.) CARRIED

413.10                Moved by Clr. Zajic that the Municipal District of Wainwright No. 61 be authorized to obtain pricing for coring the gravel pit located in the Section 13-46-4 W4M (McLean Pit) and furthermore that a coring agreement be brought forward between the M.D. and the landowner with the conditions that with the landowner pay $5,000.00 towards the coring and further that the M.D. having exclusive rights to the gravel. CARRIED

414.10                Moved by Clr. Andersen that the Municipal District of Wainwright No. 61 obtain prices from a qualified consultant to undertake a complete review of each fire department within the M.D. boundaries with the following items specifically being evaluated: Standard Operational Procedures (SOP), existing training of members, recommendation for minimum training requirements, review of equipment and any certification requirements, level of service of each department and its capabilities to fulfill the same and any other items/issues that the Consultant considers relevant. CARRIED

415.10                 Moved by Clr. Valleau that the Municipal District of Wainwright No. 61 be authorized to negotiate with Penn West for a surface lease located at 13-19- 44-6 W4M and bring back agreement to next Council meeting. CARRIED

416.10                 Moved by Clr. Buck that the Municipal District of Wainwright No. 61 enter into a Development Agreement with Tom and Jan Suley for the Bare Land Condominium located at SW 1-44-5 W4M and that the Reeve and the Administrator be authorized to sign the agreement. CARRIED
